California Cannabis Enforcement: Frequently Asked Questions
What happens if the DCC issues a Notice of Violation to an LA retail dispensary?
The matter runs on two tracks at once: the state violation becomes part of the DCC compliance file, and the Los Angeles Department of Cannabis Regulation can pursue its own Notice of Violation for the same conduct under LAMC section 104.13. Once a DCR NOV becomes final, penalties are generally due within 30 days and corrective action must be completed within 30 days, and unresolved violations resurface at renewal. A coordinated response that addresses both agencies with one consistent record is critical.
How long do you have to appeal an administrative citation from the Department of Cannabis Control?
Deadlines are short and vary by document. A DCC citation can be contested through an informal conference under 4 CCR section 17803 within the window stated on the citation; a formal accusation requires a Notice of Defense within 15 days under Government Code section 11506; and a Los Angeles DCR Notice of Suspension or Revocation must be appealed within five days of the electronic mailing date, with the appeal fee paid before the appeal counts as filed.
Can the DCC suspend a cannabis license before any hearing?
Yes. Through an Emergency Decision and Order the Department can suspend operations almost immediately when it alleges an immediate danger to public health, safety, or welfare. The licensee has a short, strictly enforced window to request an informal hearing before the Director, and the Department must then file an accusation that moves the case into the formal hearing process before an administrative law judge.
Does a Los Angeles DCR revocation affect a state DCC license?
Yes. State law conditions cannabis licensure on continued local authorization, so losing DCR authorization makes lawful operation under the state license impossible, and the state file will reflect the local action. Because the local process moves in days rather than months, the DCR case usually deserves first attention when both agencies are involved.
